Services We Provide

Our services may include:

  • Travel consultancy
  • Visa guidance
  • Application support
  • Document checking
  • Appointment assistance
  • Flight reservations
  • Hotel reservations
  • Travel insurance arrangements

The services included in your particular package will be those stated in the quotation, invoice, booking confirmation, service agreement or other written confirmation issued to you.

Anything outside the agreed scope may be treated as an additional service and may incur an additional fee, provided the additional charge is communicated and agreed before the additional work is undertaken.

3

Nature of Visa and Travel Support

Swift Holidays is an independent travel consultancy. We are not an embassy, consulate, government department or visa decision-maker.

We can assist with administrative preparation and travel-related support, but the relevant authority remains solely responsible for decisions concerning visa approval, refusal, duration, entries and conditions.

We cannot guarantee appointment availability, processing times or a particular visa outcome.

4

Client Information and Document Responsibility

You must provide information and documents that are accurate, complete, genuine, current and relevant to the service.

  • You must promptly notify us of any change in your circumstances or travel plans that may affect your application or booking.
  • You must review documents, forms and information prepared using your information and notify us of any error or omission as soon as reasonably possible.
  • You must not provide forged, altered, misleading or fraudulent documents.
  • You remain responsible for attending appointments, biometric appointments, interviews and other required appointments unless our written service specifically states otherwise.
  • We may pause or terminate a service where we reasonably believe that information or documents are false, fraudulent, unlawful or materially misleading.
5

Our Right to Refuse or Suspend a Service

We may decline, suspend or terminate a service where reasonably necessary to comply with law, where continuing would involve suspected fraud or misleading information, where required information is not provided, where payment is not received, or where the requested service falls outside our business or professional scope.

Where we terminate a service for a reason attributable to the Client, any refund will be determined in accordance with applicable law, these Terms and the work or costs already incurred.

6

Fees, Prices and Third-Party Charges

Our service fee will be communicated before or at the time of purchase.

Government, embassy, consular, visa-centre, appointment, courier, airline, hotel, insurance and other third-party charges are separate unless expressly included in the agreed price.

Third-party prices and requirements may change. Where an additional third-party charge becomes necessary, we will explain it before asking you to pay it, where reasonably practicable.

We will not impose an additional charge for optional work without first communicating the charge and obtaining your agreement, except where the law permits otherwise.

7

Authorized Payment Channels

Payments must be made only through payment methods or bank accounts officially provided or authorized by Swift Holidays through its official communication channels.

Swift Holidays is not responsible for payments made to unauthorized persons, accounts or payment channels where the payment was not authorized by the company.

You should retain a receipt, transaction reference, bank confirmation or other payment evidence.

8

Contract Formation

A service contract is formed when Swift Holidays accepts your request and the applicable payment or agreed payment arrangement has been received, unless a written agreement states otherwise.

The scope of the contract is determined by the written service description, quotation, invoice, booking confirmation or service agreement provided to you.

9

Client Cancellation

If you wish to cancel, you should notify us in writing as soon as possible.

Where a statutory cancellation right applies, we will respect that right. Where no statutory cancellation right applies, the refund position will depend on the agreed service, the work already completed, third-party costs already incurred and applicable law.

We will not automatically retain all amounts paid merely because a cancellation occurs. Any deduction should be based on an amount that is legally and contractually justified.

10

Refund Policy

Where you are legally or contractually entitled to a refund, we will process it within a reasonable period, subject to payment-provider processing times and any agreed verification requirements.

A visa refusal does not automatically create a right to a refund of Swift Holidays' service fee where we have provided the services agreed with you. Visa decisions are made by the relevant authority.

Non-refundable government or third-party fees that have already been paid or incurred on your behalf may not be recoverable where the relevant provider does not refund them.

If a service is cancelled before completion, any refund will take into account work already properly completed, reasonable and disclosed cancellation charges where applicable, and third-party costs already incurred.

11

Additional Work Caused by Client Information

If additional work is required because information supplied by the Client was materially incomplete, inaccurate or changed after preparation began, we may propose an additional fee for that additional work.

The additional fee must be explained and agreed before the additional work is undertaken, unless urgent action is necessary and the law permits otherwise.

We will not charge the Client for correcting an error caused solely by Swift Holidays.

12

Appointments and Availability

Where appointment assistance is included, Swift Holidays may use official appointment systems or authorised booking channels.

Appointment availability is controlled by the relevant embassy, consulate, government authority or visa-centre provider and is outside our control.

We do not guarantee that an appointment will be available by a particular date or at a particular time.

The Client remains responsible for attending the appointment and complying with the appointment provider's requirements.

13

Third-Party Services

Flights, hotels, travel insurance and other travel products may be supplied by independent third-party providers.

Those providers may impose their own terms, cancellation rules, refund rules, baggage conditions, exclusions and service limitations.

Where Swift Holidays acts as an intermediary or booking agent, the relevant provider remains responsible for the delivery of its own product or service, subject to applicable law.

14

Client Review and Approval

Where we prepare forms, letters, itineraries or other application materials using information supplied by you, you are expected to review them before submission where an opportunity to review is provided.

Your approval does not transfer responsibility to you for an error caused by Swift Holidays where the error was not reasonably detectable from the information you supplied.

Equally, Swift Holidays is not responsible for an error that resulted from inaccurate or incomplete information supplied by you.

15

Communication and Notices

We may communicate with you through email, telephone, WhatsApp or other contact details you provide.

You are responsible for ensuring that your contact details remain current and that you can receive important communications.

A communication is not considered proof of an official government decision unless it comes from the relevant authority.

16

Fraud, Misrepresentation and Unlawful Requests

We will not knowingly assist with forged documents, false statements, fraudulent applications, concealment of material information or any other unlawful activity.

If we reasonably suspect that a Client is attempting to use our services for an unlawful or fraudulent purpose, we may suspend or terminate the relevant service and may report the matter to an appropriate authority where legally required or permitted.

17

Payment Disputes

If you believe a payment was made incorrectly or a service issue has occurred, please contact us first so that we can investigate and attempt to resolve the matter.

Nothing in this section prevents you from exercising any statutory right or any lawful right available through your payment provider.

We may provide relevant transaction and service records to a payment provider, bank or card scheme when responding to a genuine payment dispute or chargeback.

18

Events Outside Our Reasonable Control

We will not be responsible for a delay or failure caused by an event outside our reasonable control, including embassy or government closures, appointment-system failures, airline disruption, strikes, severe weather, natural disasters, war, civil emergencies, widespread technical failures, changes in law or government policy, or decisions of third-party authorities.

Where reasonably possible, we will communicate material disruption and assist with available alternatives.

19

Limitation of Liability

We are responsible for providing our services with reasonable care and skill as required by applicable law.

To the fullest extent permitted by law, we are not responsible for losses caused solely by the acts, omissions or decisions of an independent third party or authority, including visa refusals, embassy processing delays, appointment availability, airline disruption or a third party's cancellation.

We are not responsible for losses caused by inaccurate, incomplete or misleading information supplied by the Client.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights that cannot be excluded, or any other liability that cannot legally be limited.

20

Complaints and Dispute Resolution

If you are unhappy with our service, please contact us promptly with details of the complaint so that we have a reasonable opportunity to investigate and respond.

Complaints may be sent to info@swiftholidays.co.uk or to our registered office.

Nothing in this section prevents a consumer from using any statutory complaint, dispute-resolution or court process available under applicable law.

21

Privacy and Personal Information

We process personal information in accordance with our Privacy Policy and applicable UK data protection law.

Our Privacy Policy explains how we collect, use, store, disclose and protect personal information.

22

Intellectual Property and Company Materials

Unless otherwise agreed, templates, written materials, website content, branding, original documents and other materials created by Swift Holidays remain the property of Swift Holidays or the relevant rights holder.

You may use materials supplied specifically for your own application or booking, but you must not reproduce, resell or commercially distribute Swift Holidays' proprietary materials without permission.

23

Confidentiality

We will take reasonable steps to keep Client information confidential, subject to disclosures required to provide the service, comply with law, protect legitimate interests, investigate fraud or respond to lawful requests.

The Client must also keep confidential any non-public information provided by Swift Holidays that is clearly confidential.

24

No Waiver

If Swift Holidays does not immediately enforce a provision of these Terms, that does not mean that the company has permanently waived its right to enforce that provision later.

25

Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary, and the remaining provisions will continue to apply.

26

Entire Agreement

These Terms, together with the relevant quotation, invoice, booking confirmation, service description and any written terms expressly incorporated into the contract, form the agreement between Swift Holidays and the Client concerning the relevant service.

Nothing in this section excludes liability for fraudulent misrepresentation or any statutory right that cannot lawfully be excluded.

27

Changes to These Terms

We may update these Terms from time to time. The version applicable to a service will generally be the version provided or made available when the relevant contract was formed, unless a change is required by law or agreed with the Client.

28

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws require otherwise.

Where you are a consumer, you may have additional mandatory rights under the law applicable to your place of residence. Nothing in these Terms prevents you from exercising such rights.

Legal Review

These Terms are drafted to protect Swift Holidays' legitimate commercial interests while avoiding blanket exclusions that may be unfair or unenforceable against consumers. They should be reviewed by a UK solicitor before being used as the company's final customer contract, particularly if Swift Holidays sells package travel or acts as an agent for flights, accommodation or insurance.
